1. Who you're contracting with

Flossom is operated by Simone Lisl Meuwese ("Flossom", "we", "us"), an individual sole trader. By using Flossom (the "Service") you ("you", "user") enter into a binding agreement with us under these Terms & Conditions.

2. Acceptance

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. Continued use after changes to these Terms constitutes acceptance of the updated version.

You confirm that you are of legal age to enter into a binding contract in your country of residence, and that any information you provide is accurate and kept up to date.

3. The Service

Flossom is a web application for embroiderers and cross-stitchers to catalogue thread stash, plan projects, and generate shopping lists. Features vary between the Free plan and Flossom Pro, as described on our pricing page.

4. Your account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised use of your account.

5. Acceptable use

You must not misuse the Service. In particular, you agree not to:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • send spam, malware, or otherwise interfere with the security or integrity of the Service;
  • probe, scan, scrape, or attempt to bypass any access controls or rate limits;
  • infringe anyone's intellectual property, privacy, or other rights;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • resell, sublicense, or redistribute the Service or any part of it.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is and remains the property of Simone Lisl Meuwese. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable right to use the Service for your personal or internal business use within the plan you have purchased. You retain ownership of the content you upload (such as project notes and stash data); you grant us a limited licence to host and process it solely to provide the Service to you.

7. Payments, subscriptions and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms and our Refund Policy. Flossom Pro is a recurring subscription that renews automatically until cancelled; you can cancel at any time from your account or via paddle.net.

All prices shown on our website and checkout are exclusive of any country-specific taxes, duties, or levies that may be imposed by your local jurisdiction (for example, sales tax, VAT, GST, or similar). You are solely responsible for any such taxes that may be assessed after purchase. Flossom does not collect or remit these taxes on your behalf.

8. Service availability

We work hard to keep Flossom available, but we do not guarantee that the Service will be uninterrupted, error-free, or free from loss of data. Scheduled maintenance, third-party outages, and unforeseen issues can affect availability.

9. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or in connection with the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold us harmless from any third-party claims, damages, or expenses arising from your content, your use of the Service in breach of these Terms, or your violation of any law.

11. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay subscription fees, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service and close your account at any time. On termination, your right to use the Service ends; you may request an export of your data within 30 days, after which we may delete it.

12. Changes to the Service or these Terms

We may update the Service or these Terms from time to time. Material changes will be communicated through the Service or by email where appropriate. The updated Terms apply from the date they are posted.

13. Governing law

These Terms are governed by the laws of the country in which Simone Lisl Meuwese is resident, without regard to its conflict of law rules. The courts of that country have exclusive jurisdiction over any dispute arising out of these Terms, subject to any mandatory consumer protection rights you may have in your country of residence.
